Exceptions to the Law

The state permits possession and consumption in the following circumstances:

  • Some occupations may allow for minors to handle or sell alcohol in sealed containers for retail
  • Possession and consumption may take place under the supervision of a parent or guardian
  • A physician can sell or furnish alcohol in the regular course of their practice
  • Minors can possess and consume alcohol for an established religious purposes

A DUI lawyer can work with you to present any of these reasons or other evidence to the court to defend your case. You cannot afford to face these charges without a strong legal team! Contact our firm to learn how we can defend you.

Penalties for Minor in Possession

Those in violation of laws regarding alcohol possession can be subjected to the juvenile court and can be considered criminal offenses. The judge may offer a diversion program for a first offense in which the individual refrains from any illegal activity and submits to periodic inspections over a set period. Successful completion of the program will result in dismissal of the complaint.

If the person fails the diversion program or is arrested for subsequent possession charges, the judge can make a ruling on the case. If found guilty, the person will be responsible for paying the fines and any other penalties from their first charges, as well as the subsequent offense.
