What is a Diversion Program?
Most DUI diversion programs will require a defendant to meet certain requirements, such as completing classes or other duties. Once the conditions of the program have been met, the judge or prosecutor will typically dismiss the DUI charges. These programs are designed for individuals who have made mistakes and demonstrate the ability to behave responsibly after their incident.
The following are examples of conditions included in a diversion program:
- Community service
- Substance abuse classes or programs
- Commitment to avoid future charges
In some cases, a defendant will be required to plead guilty to the charges initially until the program is complete. Other times, the court may use a deferred adjudication until the defendant attempts to complete the program. If the defendant violates the conditions in any way, they will likely be convicted of DUI. However, the details of a diversion program can often vary case by case.
